Warranty Information

General Provisions

  1. Natural person, conducting business - Sandra Debska, based in Kalisz 12 Platanowa Street , 62-800
    Kalisz, holding NIP 6182184404, REGON 524105118 hereinafter referred to as the "Manufacturer", hereby grants the recipient -.
    hereinafter referred to as "Customer" Warranty Card for the PIANO GUARD SYSTEM device hereinafter referred to: "Device"
    GUARANTEE under the terms and conditions described in this document hereinafter referred to as: "OWG".

  2. Before using the Device, please read carefully the enclosed instruction manual.

  3. The Device should be installed by an installer trained by the Manufacturer, called An Authorized Installer. Here: An Authorized Installer means a person or entity that has successfully completed training approved by the Manufacturer and has been granted authorization by the Manufacturer to install and service the Piano Guard System.

Warranty Period

  1. The Manufacturer provides a warranty for a period of twenty-four (24) months.

  2. The warranty period shall commence on the date the Piano Guard System is delivered to the Customer.

  3. Any defects reported to the Manufacturer after the expiration of the warranty period shall not be covered by this warranty.

  4. The Customer shall retain the right to pursue warranty claims after the expiration of the warranty period, provided that the defect was reported to the Manufacturer during the warranty period.

  5. If warranty repair requires the import of spare parts or components from abroad, the Manufacturer reserves the right to extend the repair period by the time reasonably necessary to obtain such parts.

Warranty Coverage and Exclusions

  1. The warranty covers defects arising during the warranty period specified in § 2(1) of these General Terms and Conditions, provided that such defects result from causes inherent in the Piano Guard System.

  2. The warranty does not cover defects or damage resulting from:

  3. a) mechanical damage;

  4. b) use, operation, or maintenance contrary to the Operating Manual or the intended purpose of the Device;

  5. c) external causes or force majeure events, including but not limited to lightning, fire, flooding, excessive temperatures, power surges, or exposure to chemical substances;

  6. d) unauthorized repairs, modifications, alterations, or interference with the Device;

  7. e) improper installation, configuration, power supply, or connection of external equipment not compliant with the Operating Manual;

  8. f) installation performed by a person who has not been authorized and trained by the Manufacturer;

  9. g) removal, damage, or alteration of seals, warranty labels, serial number labels, or other identification markings;

  10. h) use of non-original spare parts, accessories, or consumable materials not approved by the Manufacturer;

  11. i) improper selection of the Device for the specific piano or instrument.

  12. Installation and commissioning of the Piano Guard System must be performed by an installer authorized and trained by the Manufacturer. The installer shall confirm the installation in the Warranty Card or other proof of installation approved by the Manufacturer. Failure to provide such confirmation may result in refusal of warranty claims relating to installation defects.

  13. To maintain warranty coverage, the Customer shall:

  14. a) replace the cellulose humidifier pad in accordance with the schedule specified in the Operating Manual;

  15. b) refill the water tank with demineralized water whenever indicated by the controller or monitoring system;

  16. c) follow all maintenance instructions contained in the Operating Manual.

  17. The warranty does not cover consumable parts and components subject to normal wear and tear, including cellulose humidifier pads and other consumables that require periodic replacement during normal operation.

  18. The Warranty Card must not contain unauthorized alterations, corrections, or deletions. In the event of loss of the Warranty Card, the Manufacturer may, at its sole discretion, issue a replacement document upon presentation of proof of purchase.

  19. Warranty repairs shall be carried out as soon as reasonably practicable after receipt of the Device by the Manufacturer and, where possible, within twenty-one (21) days. This period may be extended in circumstances specified in § 2(5) or where factors beyond the Manufacturer's reasonable control prevent timely completion of the repair.

  20. The warranty period shall not be extended as a result of warranty repairs. However, if the entire Device or a substantial part thereof is replaced, a new warranty period shall commence for the replaced Device or part, to the extent provided by applicable law.

  21. The warranty shall become void if the Device is repaired, modified, or otherwise interfered with by any person not authorized by the Manufacturer, or if non-original spare parts are used without the Manufacturer's prior written approval.

Claim Process

  1. The Customer shall notify the Manufacturer of any defect immediately upon its discovery.

  2. A warranty claim shall be submitted in writing and should include:

  3. a) the Customer's full name and contact details;

  4. b) the details of the person reporting the defect, if different from the Customer (for example, an authorized Piano Guard System installer);

  5. c) a copy or scan of the Warranty Card or other proof of warranty entitlement;

  6. d) the original or a copy of the proof of purchase (invoice, receipt, or equivalent document);

  7. e) the serial number of the Device;

  8. f) a detailed description of the defect, including the circumstances in which it occurred and the date on which it was first observed.

  9. If the warranty claim does not contain all information necessary for its assessment, the Manufacturer may request additional information or documentation. The time required to provide such information may extend the warranty claim processing period.

  11. Prior to shipment, the Customer shall adequately secure the Device against damage during transport. The Manufacturer shall not be responsible for damage resulting from improper packaging or transportation arranged by the Customer.

  12. To preserve warranty rights within the warranty period, the Customer may initially submit a warranty claim electronically by sending the required information and supporting documentation to: info@pianoguard.com

  13. Submission of a warranty claim by e-mail during the warranty period shall be deemed timely, provided that it contains sufficient information to identify the Device and the reported defect. Any additional documentation requested by the Manufacturer may be provided subsequently.

  14. The date on which the Manufacturer receives the electronic warranty claim shall be deemed the date of notification of the defect for the purposes of determining whether the claim was submitted within the warranty period.

  15. Before requiring the return of the Device for inspection or repair, the Manufacturer may request photographs, videos, diagnostic information, or other evidence reasonably necessary to assess the reported defect. The Customer shall reasonably cooperate with such requests. The Manufacturer may also require inspection by an Authorized Installer before approving warranty service.

Manufacturer Rights & Obligations

  1. If a warranty claim is accepted, the Manufacturer shall, at its discretion, repair the defective Device or replace it free of charge with a new or refurbished Device of equivalent functionality.

  2. If the Manufacturer determines that the defect cannot be repaired within a reasonable time, the Device may be replaced with a new or refurbished Device of equivalent functionality and performance.

  3. If repair or replacement would be impossible or would involve disproportionate costs, the Manufacturer may refund the purchase price paid for the Device. In such case, the Customer shall return the Device to the Manufacturer, and the warranty shall terminate upon payment of the refund.

  4. If the Device or any of its components is no longer manufactured or available, the Manufacturer may replace it with a product or component offering equivalent or higher functionality and performance.

  5. The Manufacturer shall assess the warranty claim and notify the Customer of its decision within thirty (30) days from receipt of all information and documentation reasonably necessary to evaluate the claim.

  6. Prior to making a decision on the warranty claim, the Manufacturer may request additional information, documentation, photographs, diagnostic data, or inspection of the Device. In such case, the period specified in paragraph 5 shall be suspended until the requested information is received.

  7. If the warranty claim is rejected, the Device shall be returned to the Customer. The Customer shall bear the costs of return shipment unless otherwise required by applicable law.

  8. The remedies provided under this warranty, namely repair, replacement, or refund, shall constitute the Manufacturer's sole obligations under this warranty.

Final Provisions

  1. In the event of a dispute regarding the existence, cause, or extent of a defect, the Manufacturer and the Customer may jointly appoint an independent expert or accredited testing institution to provide a technical assessment. The costs of such assessment shall be borne by the parties in accordance with their mutual agreement or, failing such agreement, in proportion to the outcome of the assessment.

  3. This warranty is provided in addition to, and does not exclude, limit, or suspend, any rights or remedies available to the Customer under applicable consumer protection laws or mandatory statutory provisions in the country of purchase.

  4. If any provision of this warranty is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

  5. This warranty shall be governed by and interpreted in accordance with the laws of the Republic of Poland, unless mandatory consumer protection laws of the Customer's country of residence provide otherwise.

Limitation of Liability

  1. The Manufacturer's liability under this warranty shall be limited solely to the repair, replacement, or refund of the defective Device in accordance with the terms of this warranty.

  2. To the maximum extent permitted by applicable law, the Manufacturer shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of profits, loss of business opportunities, loss of data, transportation costs, piano tuning costs, restoration costs, or damage resulting from the Customer's failure to follow the Operating Manual.

  3. The Manufacturer shall not be liable for any damage to a piano or other property resulting from improper installation, misuse, lack of maintenance, unauthorized modifications, use of non-approved consumables, or operation of the Device contrary to the Operating Manual.

Device Aim

  1. The Piano Guard System is designed to assist in maintaining a stable environment within the piano. The Manufacturer does not guarantee any specific humidity level, tuning stability, performance improvement, prevention of all humidity-related damage, or preservation of any particular instrument.

Consumable Clause

  1. Only consumables approved by the Manufacturer may be used with the Device. Damage caused by the use of non-approved consumables, additives, chemicals, or water other than demineralized water is excluded from warranty coverage.

Transferability Clause

  1. This warranty follows the Device and remains valid for subsequent owners during the warranty period, provided all warranty conditions have been satisfied.

Force Majeure Protection

  1. The Manufacturer shall not be responsible for delays in warranty service resulting from events beyond its reasonable control, including but not limited to natural disasters, transportation disruptions, customs delays, labor disputes, governmental actions, or shortages of materials or components.
